Terms of Service for Cables

These Terms of Service ("Terms") govern your access to and use of the Cables mobile application ("the App"). By accessing or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this requirement.

2. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not misuse the App, interfere with its operation, or attempt to access it through unauthorized means.

3. Accounts

Certain features require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You may delete your account at any time through the App.

4. Subscriptions and Payments

The App may offer free trials and paid subscription plans in the future. All payments, billing, renewals, and cancellations are processed exclusively through Apple's App Store and are subject to Apple's terms and policies.

We do not process payments or issue refunds directly. Refund requests must be submitted through Apple.

5. Intellectual Property Rights

You retain ownership of the content you create, upload, and share, including workout data, notes, and profile information ("User Content").

By using the App, you grant us a non-exclusive, limited license to host, store, process, and display your User Content solely for the purpose of operating and improving the App.

Depending on your privacy settings, your profile and certain content may be visible to other users. Public content may be viewed by anyone using the App.

6. User Generated Content and Moderation

The App allows users to post content and interact with others. We maintain a zero-tolerance policy regarding objectionable content and abusive users.

a. Content Standards

You agree not to post content that is:

  • Defamatory, discriminatory, or mean-spirited, including references or commentary about religion, race, sexual orientation, gender, national or ethnic origin, or other protected groups
  • Sexually explicit, pornographic, or violent
  • Bullying, harassing, threatening, or intimidating toward other users

b. Reporting and Blocking

To promote a safe environment, the App provides tools that allow users to:

  • Block other users to prevent interaction and hide their content
  • Report content or users that violate these Terms or are otherwise objectionable

c. Action on Reports

We will review reported content and take appropriate action within 24 hours. This may include removing content, restricting visibility, suspending accounts, or permanently terminating access to the App.

7. Acceptable Use

In addition to the Content Standards above, you agree not to:

  • Violate any applicable laws or regulations
  • Use the App for any illegal or unauthorized purpose
  • Attempt to reverse engineer, disrupt, or compromise the security of the App
  • Create multiple accounts for the purpose of evading bans or blocks

8. Fitness and Health Disclaimer

The App may provide workout tracking, fitness-related content, and, in the future, AI-assisted workout suggestions.

The App does not provide medical advice. All content is for informational and educational purposes only and should not be considered medical, health, or professional advice. You should consult a qualified healthcare professional before starting any exercise program.

Your use of the App and any fitness activities you undertake are at your own risk.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms.

10. Availability

We do not guarantee that the App will be available at all times or without interruption. Features may change, be suspended, or discontinued at any time.

11. Disclaimers

The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the App.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by applicable laws, without regard to conflict of law principles.

15. Apple App Store Terms

This App is distributed through Apple's App Store. You acknowledge and agree that:

  • These Terms are between you and Ryan Waldon only, not Apple
  • Apple has no obligation to provide maintenance or support for the App
  • Apple is not responsible for any claims related to the App
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them
